General Terms and Conditions Physiotherapy Bonaire

Article 1: Definitions
1.1. Practice: Physiotherapy Bonaire, located on Bonaire.
1.2. Practitioner: the (pediatric) physiotherapist working at the practice.
1.3. Client: the person with whom the practice enters into a treatment agreement.
1.4. Treatment agreement: the agreement between the practice and the client for the provision of physiotherapy care.

Article 2: Applicability
2.1. These terms and conditions apply to all offers, agreements, and treatments of Physiotherapy Bonaire.
2.2. Deviations from these conditions are only valid if recorded in writing.

Article 3: Formation of agreement & Purpose of treatment
3.1. The treatment agreement is established after intake and acceptance of the treatment plan. The goal is to restore or improve physical functioning in accordance with the professional standards of the KNGF (Royal Dutch Society for Physical Therapy).
3.2. The treatment is carried out in accordance with the Medical Treatment Agreement Act (WGBO) and the applicable guidelines and quality standards (including the KNGF).

Article 4: Practice obligations
4.1. The practice provides care in accordance with the requirements of good healthcare practice.
4.2. The practitioner maintains a file in accordance with the WGBO requirements and privacy legislation.
4.3. The practice informs the client about the intended treatment, costs, and any subsequent steps.

Article 5: Client obligations
5.1. The client must truthfully provide all information necessary for adequate treatment.
5.2. The client follows the (home) exercises and advice of the practitioner to the best of their ability.
5.3. Clients must cancel appointments promptly (at least 24 hours in advance). In the event of late cancellations or no-shows, the practice may charge for the reserved time.

Article 6: Rates & Payment
6.1. The rates are based on the current rate recommendation for physiotherapy in the Caribbean Netherlands and/or the agreed rates with health insurers such as the ZVK and SVB.
6.2. Uninsured treatments, deductibles, and additional treatments are payable directly to the practice, unless otherwise agreed in writing.
6.3. Payment must be made within 14 days of the invoice date. In the event of late payment, statutory interest and collection costs will apply.

Article 7: Liability
7.1. The practice's liability is limited to the amount paid out by the professional liability insurance.
7.2. The practice is not liable for damage resulting from the client's failure to follow advice or instructions, or from their failure to follow them in a timely manner.

Article 8: Data protection
8.1. The practice processes personal data in accordance with applicable privacy legislation. See our separate privacy statement for details.
8.2. Data will only be provided to third parties with the client's express consent, unless this is legally required or necessary for the treatment.

Article 9: Complaints Procedure & Disputes
9.1. The practice has a complaints procedure in accordance with the Healthcare Professions Act (Wkkgz). Complaints can be submitted in writing to the practice.
9.2. Disputes regarding treatment can be submitted to the independent Healthcare Dispute Resolution Body (SGC) in the Netherlands, or to the designated bodies within the Caribbean Netherlands.
9.3. The law of Bonaire, as a special municipality of the Netherlands, applies to every agreement.

Article 10: Final provisions
10.1. Changes to these terms and conditions will be communicated in a timely manner and can be found on our website.
10.2. If any provision of these terms and conditions is void or unenforceable, the remainder of the terms and conditions shall remain in full force and effect.

Physiotherapy Bonaire reserves the right to amend these terms and conditions at any time. The most current version can be found on our website.
